Product Disclaimer
The BuckleGarde is a security cover that surrounds the safety buckles
used in medical and paramedical transport, deterring the patient
from actuating the push button and releasing the buckle. Its sole
purpose is to provide deterrence. Any other use of the BuckeGarde,
either implied or otherwise, is not the intent purpose of the
BuckeGarde and is therefore not the responsibility of Garde Systems
LLC. The user is responsible for evaluating and determining whether
the BuckleGarde is suitable and appropriate for a particular use and
intended application, and complies with all applicable laws,
regulations, standards, and guidance. The BuckleGarde should be
removed as soon as the qualified healthcare providers caring for the
patient feel it is safe, and only be used when the healthcare
providers deem it is appropriate.
Limited Remedy
If a BuckleGarde is defective, your exclusive remedy and Garde
Systems LLC’s or seller’s sole obligation will be, at Garde Systems
LLC’s option, to repair or replace the product or refund the purchase
price.
Limitation of Liability
Except where prohibited by law, under no circumstances, including
but not limited to negligence, will Garde Systems LLC, or its
employees be liable for any claims, special or consequential
damages, costs or cause of action that result from the use of, or the
inability to use, or that you may in the future have as a result of
injuries or damage sustained or incurred from the use of the
BuckleGarde. In no event shall the total liability to you by Garde
Systems LLC or their respective licensors or suppliers for all
damages, losses, and causes of action (whether in contract, tort or
otherwise) exceed the amount paid by you to Garde Systems LLC.
